Terms and Conditions of Sale

1. Purpose
These Terms and Conditions of Sale (T&Cs) govern the contractual relationship between Fidelizz, the trading name of the sole proprietorship Ingenisolution (SIRET: 979 971 439 00018), headquartered at 407 Route de Loyle, 82350 Albias, France (hereinafter "the Provider"), and any individual or legal entity (hereinafter "the Customer") subscribing to a plan on the platform www.fidelizz.fr.
2. Services offered
Fidelizz provides an online platform enabling merchants to create and manage digital loyalty cards compatible with Apple Wallet and Google Wallet. Services include:
- Creation and customization of digital loyalty cards
- Generation of QR codes for customer registration
- Scanning system for adding loyalty points
- Customer tracking dashboard and statistics
- Technical support
3. Pricing and payment
Current prices are displayed on the website. Fidelizz offers a free plan and paid plans. Prices are shown in euros excluding VAT. Applicable VAT will be added at checkout.
Payment is made by credit card via the secure payment platform Stripe. The subscription is monthly or annual according to the Customer's choice.
4. Term and cancellation
The subscription is taken out for an indefinite period with a monthly or annual billing cycle. The Customer may cancel their subscription at any time from their dashboard. Cancellation takes effect at the end of the current billing period.
5. Right of withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to services fully performed before the end of the withdrawal period and whose performance began with the consumer's prior express agreement.
6. Liability
Fidelizz undertakes to provide a service consistent with the description of the offers. Fidelizz's liability is limited to the amounts paid by the Customer over the last 12 months.
Fidelizz shall not be held liable for indirect damages, data loss, loss of earnings or service interruptions due to force majeure events.
7. Data ownership
The Customer retains ownership of all data entered on the platform. In the event of cancellation, the Customer may request an export of their data within 30 days.
8. Governing law and disputes
These T&Cs are governed by French law. In the event of a dispute, the parties agree to seek an amicable resolution. Failing that, the Commercial Court of Montauban shall have sole jurisdiction.
